Welcome to prop4all. These Terms and Conditions ("Terms") govern your use of the prop4all website, mobile applications, and all related services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

1. Definitions

• "Platform" refers to the prop4all website, mobile applications, and all associated services.
• "User" refers to any individual or entity that accesses or uses the Platform, including Buyers, Owners, and Promoters.
• "Buyer" refers to a User who uses the Platform to search for and enquire about properties.
• "Owner" refers to a User who lists individual properties for sale or rent on the Platform.
• "Promoter" refers to a User (real estate developer, builder, or agent) who lists multiple properties and may have a subscription plan.
• "Listing" refers to a property advertisement posted on the Platform.
• "Content" refers to any text, images, data, or other material uploaded, posted, or transmitted through the Platform.

2. Eligibility

To use prop4all, you must:

• Be at least 18 years of age.
• Be a resident of India or have a valid legal presence in India.
• Have the legal authority to enter into a binding agreement.
• Provide accurate and truthful information during registration.

By using the Platform, you represent and warrant that you meet all the above eligibility requirements.

3. Account Registration

To access certain features of the Platform, you must create an account. When registering:

• You must provide accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Obligations

As a User of prop4all, you agree to:

• Use the Platform only for lawful purposes related to real estate transactions.
• Provide accurate and truthful information in all listings, enquiries, and communications.
• Respect the intellectual property rights of prop4all and other Users.
• Not engage in spam, harassment, or any form of abuse towards other Users.
• Comply with all applicable laws of India, including the Indian Contract Act, Transfer of Property Act, and the Information Technology Act, 2000.

5. Property Listings

Listing Requirements

• All property listings must contain accurate, truthful, and complete information about the property.
• Property photos must be genuine and represent the actual property being listed.
• Pricing information must be accurate and reflect the actual asking price.
• Location details must be correct and verifiable.

Listing Review

prop4all reserves the right to review, edit, or remove any listing that violates these Terms, contains misleading information, or is deemed inappropriate. Listings may take up to 24 hours for review before being published.

Listing Liability

prop4all is a platform that connects property buyers and sellers. We do not own, lease, or manage any properties listed on the Platform. All property transactions are between the respective parties. prop4all is not a party to any real estate transaction and does not guarantee the accuracy of any listing.

6. Subscription Plans & Payments

• Free accounts allow limited property listings as specified in the current plan structure.
• Paid subscription plans offer additional features and listing capacity.
• All payments are processed securely through Razorpay.
• Subscription fees are non-refundable except within the first 7 days of purchase.
• Plans automatically expire at the end of the subscription period and do not auto-renew.
• prop4all reserves the right to modify pricing with prior notice to existing subscribers.

7. Intellectual Property

All content on the Platform, including but not limited to the website design, logos, text, graphics, software, and trademarks, are the property of prop4all or its licensors and are protected under applicable Indian intellectual property laws.

By posting Content on the Platform, you grant prop4all a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your Content solely for the purpose of operating and promoting the Platform.

8. Prohibited Activities

You agree not to:

• Post fake, fraudulent, or misleading property listings.
• Impersonate another person or entity.
• Scrape, crawl, or use automated tools to extract data from the Platform without written permission.
• Attempt to gain unauthorized access to our systems, servers, or user accounts.
• Upload malware, viruses, or any harmful code.
• Use the Platform for money laundering, illegal property transactions, or any unlawful activity.
• Circumvent or attempt to circumvent any security measures of the Platform.
• Post content that is defamatory, obscene, threatening, or violates any third-party rights.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. prop4all does not warrant that:

• The Platform will be uninterrupted, error-free, or secure.
• The information on property listings is accurate, complete, or current.
• Any property transaction facilitated through the Platform will be satisfactory.
• The Platform will meet your specific requirements.

Users are advised to independently verify all property details, legal documents, and ownership before entering into any transaction.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, prop4all and its directors, officers, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, or business opportunities.
• Any losses arising from property transactions between Users.
• Any unauthorized access to or alteration of your data.

In no event shall our total liability exceed the amount paid by you to prop4all in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless prop4all and its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising out of or related to your use of the Platform, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Platform immediately ceases.
• Your active listings will be deactivated.
• We are not obligated to refund any subscription fees for the remaining period.
• Provisions regarding intellectual property, limitation of liability, indemnification, and governing law shall survive termination.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.

Before initiating any legal proceedings, the parties agree to attempt to resolve disputes through good-faith negotiations for a period of 30 days. If negotiations fail, disputes may be resolved through arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Chennai, Tamil Nadu.

14. Changes to Terms

prop4all reserves the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Platform.
